The rules

What the law asks of a gallery in the US

Tax

Sales tax

  • There is no federal sales tax. Each state, and often its cities and counties, sets its own rates and rules.
  • Since South Dakota v. Wayfair (2018), a state can require a seller outside the state to collect its sales tax once sales into the state pass a threshold the state sets.

Privacy

Privacy laws by state

  • There is no single federal privacy law for businesses. California's Consumer Privacy Act, as amended by the CPRA, and similar laws in other states apply to businesses above their size thresholds.

Anti-money-laundering

Anti-money-laundering

  • The Anti-Money Laundering Act of 2020 added people who trade in antiquities to the Bank Secrecy Act and directed FinCEN to write rules for them. Art dealers were not added; the Act called for a study of the art market instead.

How Artfolio helps

Built in, on every plan

Invoices in US dollars

Invoices, proformas and offers in US dollars or any of more than 160 currencies, each document keeping its own.

Your EIN on every document

Add your EIN in Settings, and your buyers' on their contacts. Artfolio checks the format and prints each under the name its country uses: ABN, VAT number, GST/HST number, TRN or Tax ID.

Sales tax at the rate you set

Set your sales tax rates on your letterhead, and choose tax-inclusive or tax-exclusive prices line by line.

Consent and data requests

Record who agreed to marketing, how and with what wording. Export or erase one person's data, and track requests to see, correct or delete data with a due date.

Access for the right people

Roles and permission templates decide who sees collector details and prices, and your team can be required to use two-factor sign-in.

Where your data lives

Your database, sign-in, uploaded files and backups are hosted in Mumbai, India (AWS ap-south-1), and the Artfolio app runs on servers in Mumbai. The database is backed up automatically every day, and the last seven days of backups are kept, also in Mumbai.

Still yours to do

What stays with your gallery

  • Register for sales tax where you must, and file the returns. Artfolio applies the rate you set; it doesn't look up the rate for each buyer's address.
  • Check how your state taxes shipping, framing and installation on an art sale.
  • Take advice from your accountant and lawyer for your gallery's situation.
